Charged twice. One charge was under section 9 (disobeying lawful orders from a superior officer) and 12 (deserting or encouraging others to desert) which led to is conviction. He was convicted on September 25, 1917 and the sentence was modified to 10 years penal servitude and subsequently suspended February 2, 1919. The second charge was under section 19 (drunkenness).
